Terms of Use
1. Scope
These terms apply to the use of the technical services provided by Funnelgorithm (analytics, tracking, account and balance management APIs) as well as the website funnelgorithm.com. They are addressed to the connected property operators who use these services under a separate service agreement.
End users of the connected properties (e.g. users of morehits4u.com) are not direct contractual partners of Funnelgorithm. The terms of use of the respective property apply to them.
2. Description of Services
Funnelgorithm provides in particular the following services:
- Central user account and balance management
- Event tracking and analysis
- Conversion and funnel analysis
- Rotation and management of traffic links
The specific scope, usage volume and remuneration follow from the individual service agreement between Funnelgorithm and the respective property operator.
3. Access and Authentication
Access to the API services is exclusively via personal API keys. The property operator is obliged to keep these keys confidential and to protect them from unauthorised access. In case of suspected compromise, Funnelgorithm must be notified without delay so that the key can be revoked and replaced.
4. Permitted Use
The services may only be used for the agreed purpose and in compliance with applicable law. In particular, the following are prohibited:
- transmission of unlawful, deceptive or third-party rights-infringing content
- automated abuse (e.g. mass requests outside agreed quotas, bypassing rate limits)
- disclosure of API keys to third parties without consent
- violation of third-party rights, in particular data protection, copyright or trademark rights
5. Availability and Maintenance
We endeavour to keep the services permanently and reliably available. However, a claim to a specific level of availability only exists within the framework of the respective individual service agreement. Maintenance and update work will be announced where possible, but may also be carried out at short notice if security-relevant.
6. Liability
Funnelgorithm is liable for damages only in the case of intent and gross negligence; in the case of simple negligence only for breach of essential contractual obligations (cardinal obligations) and limited to damages foreseeable and typical for the contract. Liability under the Product Liability Act remains unaffected. For data loss, we are liable only to the extent that the property operator maintains reasonable, regular data backups.
7. Changes to the Terms
We reserve the right to adapt these terms for material reasons (e.g. legal changes, technical developments, protection against abuse). Changes will be communicated to the property operator in advance in an appropriate manner.
8. Applicable Law and Place of Jurisdiction
Austrian law applies, excluding the referral provisions of international private law and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from or in connection with the use of the services is, to the extent legally permissible, Leoben (Austria).
